These Terms of Service (the "Terms") form a binding agreement between you and Global Tech Service Solutions Inc. ("OFMJobs", "we", "us", or "the Company"), the entity that operates the OFMJobs platform (the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.
1. Description of services
OFMJobs is a recruitment, assessment, and operations platform for businesses hiring at scale. The Platform serves three primary user types:
- Job Seekers — individuals exploring job opportunities, completing skills and chatbot assessments, and managing applications.
- Employers — businesses posting jobs, sourcing candidates, running assessments, and managing their workforce.
- Organisation Members — invited team members of an Employer, with role-based access (Admin, Manager, Member, Trainee).
The Platform is powered by artificial intelligence across multiple workflows, including candidate scoring, content moderation, profile summaries, search relevance, and live chatbot assessments. By using the Platform, you consent to artificial intelligence processing of your data as described in Section 6 (Artificial Intelligence Processing).
2. Eligibility
You must be at least 18 years old to use the Platform. By accessing the Platform, you represent that you meet this age requirement and that you have the legal capacity to enter into these Terms in your jurisdiction.
3. Account registration and authentication
To use most features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date.
Authentication. All accounts use one-time-passcode (OTP) authentication. When you sign in, we send a single-use code to the email address registered to your account, which you enter to complete sign-in. Accounts do not use passwords.
Because the OTP is delivered by email, the address registered to your account is the credential for that account. You are responsible for maintaining control of that address and of the device used to receive codes, and for any activity under your account. Notify us immediately at support@ofmjobs.com if you suspect unauthorised access.
Valid email address required. You must register using a durable email address that you control and will continue to control. Disposable, temporary, or "burner" addresses, including those provided by throwaway-inbox services, are not permitted. Because sign-in and account recovery both depend on receiving a one-time passcode at that address, an address that expires, is shared, or is publicly accessible leaves you unable to reach your own account and compromises its security. We may refuse registration from addresses we identify as disposable, and may suspend or terminate accounts found to be using them.
Organisation Members. Employers may invite additional users to act as Organisation Members under the Employer's account. Each Organisation Member is assigned a role by the Account Owner (Admin, Manager, Member, or Trainee), and has access only to the features and data granted by their assigned role. The Account Owner is responsible for the conduct of all Organisation Members under their account, including any breaches of these Terms.
4. Acceptable use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable law;
- Post, transmit, or otherwise make available any content that is unlawful, defamatory, fraudulent, infringing, harassing, or otherwise objectionable;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Submit false, misleading, or deceptive information in any profile, job posting, application, or test;
- Register or maintain an account using a disposable, temporary, or "burner" email address, or create multiple accounts in order to circumvent plan limits, feature restrictions, or enforcement action;
- Use the Platform to recruit for, advertise, or solicit business unrelated to hiring;
- Attempt to interfere with, compromise, or disrupt the Platform's integrity, performance, or security;
- Reverse engineer, scrape, or use automated means to access the Platform other than through interfaces we expressly provide;
- Circumvent any access, rate, or feature limits imposed by your plan;
- Use the Platform to drive users off-platform in violation of Section 10 (Off-platform funnelling prohibition);
- Use third-party tools, scripts, AI assistants, or other automation during a test session in violation of Section 9 (Anti-cheat measures);
- Resell, sublicense, or otherwise commercialise the Platform without our written consent.
We reserve the right to investigate suspected violations and to take any action we consider appropriate, including content removal, account suspension, or account termination.
5. Communication
OFMJobs operates a multi-channel communication architecture:
- User-to-User communication. Job Seekers and Employers communicate primarily through OFMJobs' in-platform chat. Messages exchanged on the Platform are stored on OFMJobs' infrastructure and may be reviewed by AI moderation systems for compliance with these Terms.
- System and account notifications (sign-in codes, security alerts, account status, billing) are delivered via our transactional email infrastructure (operated through a third-party email delivery provider). These cannot be disabled.
- Marketing and product communications are delivered via our marketing email infrastructure (operated through a third-party email delivery provider). You may opt out at any time through account settings or unsubscribe links.
- In-app notifications are delivered through the Platform UI.
- Customer support is provided through a web-based support chat widget operated by a third-party support platform. Support interactions may be reviewed by OFMJobs staff and AI systems for quality assurance.
- Telegram. We operate an optional Telegram channel (@ofmjobsapp) for product announcements and job-post broadcasts. Telegram is not required for any Platform functionality.
Specific third-party providers are listed in our Privacy Policy and may change from time to time; we will provide notice of material changes in line with the Privacy Policy update procedure.
6. Artificial intelligence processing
OFMJobs employs artificial intelligence ("AI") across multiple Platform features. By using the Platform, you consent to AI processing of your data as described in this section and as further detailed in our Privacy Policy.
AI features active on the Platform include: candidate scoring, profile summary generation, AI-assisted job-post drafting, AI-powered candidate search, content moderation, off-platform funnelling detection, Chatbot Test persona dialogue, Chatbot Test scoring (AI judge), and test-response quality evaluation.
No training on your data. OFMJobs does not use your data to train AI models. Our data processing agreements with our AI service providers prohibit those providers from training their models on data submitted to them via the Platform.
AI service providers. We use third-party AI service providers (currently OpenAI and Anthropic; subject to change). Data submitted for AI processing is subject to those providers' data handling terms, as constrained by the no-training commitment above. The current list of AI sub-processors is maintained in our Privacy Policy.
Accuracy disclaimer. AI outputs are generated by automated systems and may contain errors, omissions, or inaccuracies. We do not warrant the accuracy of AI-generated content. You are responsible for reviewing AI outputs before acting on them.
Automated decisions and the right to human review. Where AI processing makes a decision with significant effects on you (such as AI applicant scoring informing a hiring decision, AI moderation rejecting a job post or content, AI test evaluation affecting test scores, or automatic termination of a test attempt for excessive tab-switching), you have the right to request human review of the decision, express your point of view, and contest the decision. Contact support@ofmjobs.com to exercise these rights.
Right to opt out. Where required by applicable law, you may request that AI processing of your data be limited. Such requests may impact Platform functionality.
7. Chatbot Tests
Chatbot Tests are AI-powered live conversation simulations used by Employers to assess Job Seekers' communication, sales, and customer-handling skills. A Job Seeker chats live with an AI persona for approximately 15–30 minutes; the conversation is scored by an AI judge against an objective-specific rubric.
Credit-based commercial model. Chatbot Tests are consumed using AI credits. Every Employer plan includes 1,000 AI credits per month, regardless of tier. Included monthly credits do not roll over month-to-month. Purchased credits do not expire.
- Free plan: 1,000 AI credits per month. Free plan holders cannot purchase additional credits and must upgrade to Plus or Enterprise to run further tests.
- Plus plan: 1,000 AI credits per month included. Plus plan holders may purchase additional credits at $1 USD per 1,000 credits (subject to change with notice).
- Enterprise plan: 1,000 AI credits per month included. Enterprise plan holders may purchase additional credits at $1 USD per 1,000 credits (subject to change with notice).
Credit cost per test. A Chatbot Test consumes 500 AI credits.
25% completion threshold. Credits for a Chatbot Test are provisionally reserved when the test is launched but only confirmed as consumed when the Job Seeker reaches 25% of the chat session. If the Job Seeker quits before 25%, the credits are returned to the Employer's balance and the Employer does not receive any test results. Once the 25% threshold is crossed, the credits are consumed regardless of test outcome.
Session ceiling. Each Chatbot Test session has a maximum of 100 chat exchanges. Sessions reaching this ceiling end automatically and are scored on the partial transcript.
Attempts and re-use across Employers. A Job Seeker only needs to complete a Chatbot Test once. When a subsequent Employer sends the same Chatbot Test to a Job Seeker who has already completed an attempt, the Job Seeker is presented with an active choice between two paths — neither path is automatic; the Job Seeker must actively select one:
- (a) Recycle the previous result — share the existing score, AI verdict, and full chat transcript with the new Employer. No new chat session is run, no credits are charged to the receiving Employer, and live observation is not available (there is no session to observe). The Job Seeker's previously stored canonical result is delivered to the new Employer as-is, marked as a recycled previous result.
- (b) Take the test again — run a fresh Chatbot Test session under the standard rules (credit charge subject to the 25% completion threshold, anti-cheat measures, live observation enabled). The new score, AI verdict, and transcript replace the Job Seeker's prior canonical record going forward; subsequent Employers will see the new result.
The recycle-or-retake choice is presented to the Job Seeker every time a new Employer sends the test (i.e. the decision is made fresh per incoming send, not once-and-final). By selecting to recycle a previous result, the Job Seeker authorises OFMJobs to share their previously stored score, AI verdict, and transcript with the receiving Employer.
Recording and storage. Chatbot Test sessions are recorded in full (chat transcripts) and stored on the Platform. Transcripts are visible to: the Employer who ran the test (post-completion only; pre-25%-threshold sessions are not surfaced), any subsequent Employer to whom the Job Seeker has chosen to recycle the result, the Job Seeker (in their own test history), the Platform's AI moderation and quality assurance systems, and OFMJobs staff (under access controls; for support, abuse review, and quality assurance only). Transcripts are retained per the Privacy Policy.
Live observation by Employers. Employers may observe Chatbot Test sessions in real time while a Job Seeker is taking the test. Employers can view the live chat transcript as the conversation unfolds. Job Seekers are not notified when an Employer is observing their session. This is necessary to preserve test integrity, as advance notification would alter the Job Seeker's behaviour and invalidate the assessment. Observation is read-only; Employers cannot interject. Live observation is permitted regardless of session completion, but persisted results, AI scoring, and post-session transcript access are only delivered to the Employer if the 25% threshold is crossed. Live observation does not apply on the recycle path described above, since no fresh session runs.
Your consent. By taking a Chatbot Test, the Job Seeker consents to live observation by the Employer running the test, full chat transcript storage, AI evaluation and scoring of the transcript, and sharing of test results (score, AI verdict, transcript) with the Employer who ran the test. By later choosing to recycle a previously completed result, the Job Seeker additionally consents to the sharing of that previously stored result — including the previously generated transcript — with the subsequent Employer making the request.
Prohibited conduct. Job Seekers may not use external tools, scripts, AI assistants, or other automation during a Chatbot Test. Detection of such use will result in disqualification of the test result and may lead to account suspension.
8. Skills tests
The Platform offers skills tests covering general competencies (such as typing speed and internet speed) and role-specific assessments. Tests may be taken on a Job Seeker's own initiative ("self-driven") or in response to an invitation from an Employer attached to a job application or sent directly.
By taking a test you agree to follow the test instructions, not to use external tools or assistance unless expressly permitted by the test, and to the anti-cheat measures set out in Section 9.
9. Anti-cheat measures for tests
To maintain the integrity of OFMJobs' skill assessments and Chatbot Tests, the Platform implements anti-cheat measures during test sessions. By initiating a test, you consent to the following:
- Copy-paste prevention — clipboard paste actions are disabled during active test sessions.
- Tab-switch monitoring and automatic termination — switching browser tabs or windows, or minimising the browser, during a test is detected, counted, and persisted. The first instance triggers a warning. Excessive tab-switching results in the test attempt being automatically terminated and flagged as a suspected integrity violation. Flagged attempts are visible on the Job Seeker's profile to any current or future Employer reviewing them.
- Randomised question pool — questions are drawn randomly from a larger bank, so two Job Seekers taking the same test will not see identical questions or sequences.
- Retry limits — each test has a maximum number of attempts (typically one attempt per skills test; for Chatbot Tests, see Section 7).
- AI-driven response evaluation — long-form test responses are evaluated by AI for quality, coherence, and rubric compliance.
- External tool prohibition — you must not use external tools, scripts, AI assistants, or other automation during a test. Detection may result in disqualification and account suspension.
We may add or modify anti-cheat measures over time, including, in a future phase, webcam screenshot capture (subject to additional consent disclosure when introduced).
10. Off-platform funnelling prohibition
Employers must not use the Platform to drive Job Seekers off the Platform before they have applied to a position or completed the in-platform application flow. Prohibited behaviour includes, without limitation:
- Posting external messaging-platform handles (WhatsApp, Telegram, Discord, etc.) in job descriptions or instructions;
- Directing Job Seekers to apply via an external website, email address, or messaging service instead of the in-platform application;
- Using a job post or the messaging system to recruit for off-platform deals or to bypass platform fees;
- Replacing platform-canonical test-invitation messages with custom contact-funnel text.
We use AI-powered content moderation and additional platform-enforced controls to detect off-platform funnelling. Violating job posts and messages may be automatically rejected, suspended, or removed. Repeated violations may result in account suspension or termination.
Job Seekers who are asked by an Employer to communicate off-platform before applying may report this via the in-app report function. Communication off-platform after the application has been accepted (for example, for interview scheduling) is permitted.
11. Pricing and plans
OFMJobs offers three subscription tiers for Employers. Posting limits refer to the number of job postings the Employer may keep active concurrently at any one time, not a per-month cap.

Rollover. Included monthly Contact tokens and AI credits do not roll over month-to-month. Purchased AI credits do not expire.
Legacy V1 plan holders (Legacy Plus). Customers migrated from OFMJobs V1 retain their original allowances under a grandfathered Legacy Plus arrangement. The specific token, contact, and posting allowances for Legacy Plus customers reflect their V1 plan terms and are recorded in their billing profile and visible within in-platform account settings. Legacy Plus customers retain access to V2 Platform features; their commercial limits remain on the V1 terms until they voluntarily switch to a current Plus or Enterprise plan.
Promotional offers. We may offer time-limited promotional discounts (for example, a discount on tier upgrades during a launch window). Promotional terms are communicated at the time of the offer.
Changes to pricing and limits. Pricing and tier limits are subject to change with reasonable notice. Updates will be communicated by email and in-platform.
12. Billing, payment, and refunds
All subscription billing and payment processing is handled through Stripe. Employers have access to a Stripe-hosted billing portal to view and download invoices, update payment methods, change subscription plans, and cancel subscriptions.
Payment is collected automatically at the start of each billing cycle from the payment method on file. Failed payments may result in plan downgrade or service suspension until payment is resolved.
Refunds. Subscriptions are non-refundable except where required by applicable law. AI credit and token purchases are non-refundable once issued, except as adjusted by the 25% completion threshold described in Section 7.
New-subscription money-back guarantee. New subscriptions include a 30-day money-back guarantee. If you are dissatisfied with the service within 30 days of your initial subscription purchase, contact support@ofmjobs.com to request a full refund. This guarantee applies to the initial purchase of a new subscription only; it does not apply to renewals or to token purchases.
Disputes and chargebacks. Billing disputes should be raised first by contacting support@ofmjobs.com. Unresolved disputes may be escalated through Stripe. Chargebacks issued without prior communication may result in account suspension.
13. Affiliate program
OFMJobs operates an affiliate program available to all registered users (both Job Seekers and Employers). Each user is provided with a personal referral code that, when used by a new sign-up, attributes the referral to the referring user.
Commercial terms. The current commission rate, commission window, payout schedule, minimum payout threshold, and applicable fees for the affiliate program are published within the in-platform Affiliate dashboard and apply to all affiliate activity at the time it occurs. We may update these terms from time to time; the version displayed in the Affiliate dashboard governs at the time of the relevant activity. By participating in the affiliate program, you agree to the terms displayed in the Affiliate dashboard at the time of your referral.
Payouts. Affiliate payouts are made via cryptocurrency only, in the supported currencies specified in the Affiliate dashboard.
Conversion tracking. We track attributed sign-ups, paid conversions, and other affiliate-relevant events through cookies and account-level attribution.
Prohibited conduct. The following will result in forfeiture of affiliate earnings and may result in account suspension: self-referrals; fraudulent sign-ups (fake accounts created to claim referral rewards, including accounts registered using disposable or "burner" email addresses); misrepresentation of OFMJobs services in promotional materials; spam-based referral promotion.
14. Organisation member roles and limits
Employer accounts may invite additional users as Organisation Members under the Employer's primary account. Each Organisation Member is assigned a role with corresponding access:
- Admin — full account access, including billing, member management, and all hiring features;
- Manager — access to hiring features and team management; no billing access;
- Member — access to hiring features only;
- Trainee — access to assigned training and limited hiring features (active from a future Phase 4 release).
The Account Owner is responsible for the actions of all Organisation Members under their account, including any breaches of these Terms.
Plan-tier limits on Organisation Members: Free — 1 (Account Owner only); Plus — up to 5 members; Enterprise — unlimited members.
Organisation Members may be removed by the Account Owner at any time. Upon removal, the member loses access to the Employer's account but may retain a personal Job Seeker profile if they had one.
15. Verified Employer badge
Plus and Enterprise plan holders display a "Verified Employer" badge on their profile and careers page. The badge indicates active paid status and is not a verification of the Employer's identity, business legitimacy, or hiring practices. We do not warrant any Employer's identity or conduct beyond confirming their active subscription status.
16. Content and intellectual property
Your content. You retain ownership of content you submit to the Platform (job posts, profiles, applications, messages, test responses, etc.) ("User Content"). By submitting User Content, you grant us a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, display, distribute (to the intended recipients on the Platform), and process the User Content for the purposes of operating, providing, improving, and securing the Platform. This licence ends when the User Content is deleted, except where retention is required by law or by these Terms.
Our content. All Platform interfaces, designs, code, trademarks, and other materials provided by us are owned by us or our licensors. You receive a limited, non-exclusive, non-transferable licence to access and use the Platform during the term of these Terms, solely for its intended purposes.
Feedback. Any feedback or suggestions you provide may be used by us without obligation to you.
17. Data protection and privacy
Our collection, use, storage, and sharing of your personal data is governed by the OFMJobs Privacy Policy (https://ofmjobs.com/privacy), which is incorporated into these Terms by reference. You have rights under applicable data-protection law (including, where applicable, the right of access, rectification, deletion, portability, objection, restriction, withdrawal of consent, and review of automated decisions). You may delete your account directly from in-platform account settings (self-serve deletion). To exercise other rights, contact support@ofmjobs.com.
18. Disclaimers
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free from harmful components. We do not warrant the accuracy, completeness, or usefulness of any AI-generated output, candidate profile, job post, or other User Content.
19. Limitation of liability
To the maximum extent permitted by law, in no event will the Company, its affiliates, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with these Terms or your use of the Platform, even if we have been advised of the possibility of such damages.
Our aggregate liability arising out of or in connection with these Terms or your use of the Platform will not exceed the greater of (a) the total amount you have paid to us in the 12 months preceding the event giving rise to the claim or (b) USD 100.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
20. Indemnity
You agree to indemnify, defend, and hold harmless the Company and its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your User Content; (b) your use of or activity on the Platform; (c) your breach of these Terms or violation of any applicable law; or (d) your infringement of any right of any third party.
21. Suspension and termination
We may suspend or terminate your account, or restrict your access to all or part of the Platform, at any time, with or without notice, if we reasonably believe that you have breached these Terms, that suspension or termination is necessary to protect the Platform or its users, or that we are required to do so by law.
You may terminate your account at any time through in-platform account settings (self-serve deletion). Termination does not affect any rights or obligations that accrued before termination, including obligations to pay fees due.
Provisions that by their nature should survive termination (including Sections 16, 17, 18, 19, 20, 21, 23, and 24) will survive.
22. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Platform, by email, or by other reasonable means at least 30 days before the changes take effect (or such longer period as is required by applicable law). Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
23. Governing law and jurisdiction
These Terms, and any dispute arising out of or in connection with them, are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
To the extent permitted by applicable law, any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
Nothing in this section affects any non-waivable rights you may have under the mandatory laws of your country of residence.
24. Miscellaneous
Entire agreement. These Terms, together with the Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and us with respect to the Platform.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
Notices. Notices to you may be provided by email to the address on file or by posting on the Platform. Notices to us should be sent to support@ofmjobs.com.
